Amendments to the General Retail Industry Award 2020
The Fair Work Commission has amended the General Retail Industry Award 2020 with 2 significant changes:
Rostering arrangements – Clause 15.7(c)
- If an employee works 6 days in one week of a 2-week roster cycle, then the employee can only work ordinary hours on a maximum of 4 days in the other week of that cycle.
- This means that an employee can work up to 4 days in the first week and 6 days in the second week. Previously, the week of up to 4 days had to follow the week of 6 days.
- There is no change to the total number of days an employee can work in a fortnight.
Overtime for part-time employees
- Part-time employees now receive overtime rates when they:
- Work in excess of their guaranteed hours as agreed – i.e. agreed in writing to work Monday to Wednesday from 8am to 4pm; or
- Outside the span of ordinary hours.
- Clause 15.1 provides the span of hours to be Monday to Friday, inclusive, are from 7.00am – 9.00pm.
- unless the business is a newsagency, video shop, or if the trading hours of the retailer extend beyond 9.00pm on a Monday to Friday or 6.00pm on a Saturday or Sunday. There are different provisions for span of hours.
- Clause 15.1 provides the span of hours to be Monday to Friday, inclusive, are from 7.00am – 9.00pm.
